Cruise Experts Travel's Epic Cruise Contest Official Contest Rules

IMPORTANT: PLEASE READ THESE OFFICIAL RULES BEFORE ENTERING CRUISE EXPERTS TRAVEL'S WIN AN EPIC CRUISE CONTEST (THE "CONTEST"). BY ENTERING THE CONTEST, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES AND REGULATIONS. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND DOES NOT

1. Contest Description. The Contest begins February 15, 2012 at 10 a.m. (PT) and ends on April 27, 2012 at 10 a.m (PT) (“Contest Period”). Through this Contest, CruiseExperts Travel dba Cruise Experts Travel and Norwegian Cruise Line invite you to submit a video, maximum one to two minutes in length, for consideration to be placed on the website EuropeCruiseExperts.com for public voting. Entries are accepted February 14, 2012 at 10 a.m. (PT) to March 14, 2012 at 10 a.m. (PT). Five (5) finalists will be chosen by Cruise Experts Travel and another five (5) finalists will be chosen by the public. Finalists chosen by the public are determined by the most number of likes the video receives on EuropeCruiseExperts.com. Ten (10) finalists will be announced March 15, 2012. The winner of the Contest will be voted by the public and determined by the most likes. Voting ends April 27, 2012 at 12 p.m. (PT). The winner of the Contest will be announced on April 30, 2012.

In order to win the Prize, you must be a Facebook fan of Cruise Experts Travel. Cruise Experts Travel reserves the right to terminate the contest should the minimum number of fifty (50) of entries are not received.

All contestants will receive a $50 onboard credit if a future Norwegian cruise is booked through Cruise Experts Travel.

2. Eligibility. The Contest is open to legal residents of Canada (excluding Quebec), the 50 United States (and D.C.) and Puerto Rico, who are at least twenty-one (21) years old at the time of entry. Void where prohibited. Contest is subject to all applicable federal, state and local laws. To be eligible to compete in the Contest, entries must be received by Cruise Experts Travel by 10 am March 13, 2012 (“Entry Deadline”) and must meet these eligibility requirements. Contestants must have the legal right and any and all permissions necessary to submit the Entry Materials (as defined in these Official Rules). By participating in the Contest, you agree that you have all rights necessary to enter and participate in this Contest and grant to Cruise Experts Travel the rights described in these Official Rules.

The following persons are not eligible to enter the Contest: (a) employees of Cruise Experts Travel ; (b) employees of Norwegian Cruise Line their immediate family; (c) individuals engaged in the development, production, administration, execution and distribution of materials for the Contest; (d) immediate family members of any person in any of the preceding categories, or who reside in the same household as any person in any of the preceding categories; and (e) persons employed at a travel agency.

3. How to Enter. During the Entry Period, upload your video onto YouTube and email the video link to Contest@CruiseExpertsTravel.com. No limit on the number of entries submitted per contestant. All entry emails must include your full name and telephone number and be received by the Entry Deadline March 14, 2012 at 10 a.m. (PT).

The video must be original and Entries may not contain material that violates or infringes any third party’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement. Videos must be developed in good taste, and shall not contain content that is obscene or indecent, and shall not include profanity, references to drugs or alcohol, or words that may be offensive to individuals of a specific race, religion, ethnicity, sexual orientation or socioeconomic group, or other content deemed inappropriate by Cruise Experts Travel. In the event an Entry is deemed inappropriate by Cruise Experts Travel, that Entry will be deemed ineligible. Cruise Experts Travel is not responsible for late or misdirected entries, or for electronic, network, computer, hardware or software malfunctions, failures or difficulties.

4. Entries and Related Materials. By submitting an Entry, each contestant agrees to and irrevocably assigns and transfers to Cruise Experts Travel any and all right, title and interest, including but not limited to all trademark, copyright, and any other intellectual property rights throughout the world, that the contestant has or may have in the Entry and all other related materials provided to Cruise Experts Travel or otherwise prepared in connection with the Contest (collectively, “Entry Materials”) in any way, including, but not limited to the contestant’s name, voice, image, photograph, likeness, city and state of residence. The Entry Materials will not be returned. Cruise Experts Travel’s rights with respect to the Entry Materials include, but are not limited to: (a) the exclusive right to use, publish, display or reproduce images on products, packaging, advertising for purposes of trade and any other lawful purpose; (b) the exclusive right to alter, revise or change the Entry Materials in any way; (c) the exclusive right to secure trademark and copyright registrations and other rights in the Entry Materials, anywhere throughout the world; and (d) the exclusive right to license, exploit, sell, assign, or otherwise dispose of the Entry Materials or any of the said rights included therein for any purpose which Cruise Experts Travel may see fit. Each contestant acknowledges and agrees that Cruise Experts Travel shall have the right, but not the obligation, to use, modify, reproduce, publish, perform, display, distribute, make derivative works of, trademark or otherwise register, and otherwise commercially and non-commercially exploit the Entry Materials in perpetuity and throughout the universe, in any manner or medium now existing or hereafter developed, without separate compensation to any contestant or any other person or entity or prior approval by contestant or any other person or entity. Each contestant agrees to take, at Cruise Experts Travel’s expense, any further action (including without limitation, execution of affidavits and other documents) reasonably requested by Cruise Experts Travel to effect, perfect or confirm Cruise Experts Travel’s rights as set forth in this Paragraph 4.

5. Winner Selection. On March 15, 2012, ten (10) finalists will be announced. Selection of five (5) finalists will be made by the public and based on the most number of likes. The remaining selection of five (5) finalists will be made by a panel of judges (collectively, “Judges”) selected by Cruise Experts Travel in its sole and absolute discretion.

The number of Likes is carried over from the Entry period. At the end of the Contest Period, the Winner is determined by the most number of Likes. The Winner is subject to verification of eligibility and compliance with the Official Rules. In the event of a dispute regarding prize claims or entries received from multiple contestants having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry to enter will be deemed to be the contestant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.

In the event the Winner is a current Cruise Experts Travel client sailing aboard a Norwegian cruise in Europe in 2012, the Winner will be credited $4500 towards the purchase price.

6. Prize. The Winner will receive the following prize (“Prize”): A cruise for two aboard the Norwegian Epic sailing roundtrip Barcelona. Date to be determined but will be in 2012. Trip includes the following: Roundtrip air for two from New York’s John F. Kennedy International Airport or Toronto's Pearson International Airport, Barcelona city tour, one night hotel accommodation, hotel breakfast, ground transportation to/from destination airport and point of embarkation/debarkation, balcony stateroom accommodations (double occupancy), onboard meals, government fees and port taxes (ARV: $4500 USD). Spa services, casino, onboard gratuities, gift shop, excursions and any optional onboard expenses are not included. All terms and conditions of Norwegian’s Standard Ticket Contract of Passage, as well as those stated in the General Information of the cruise line’s brochure, shall be applicable to this promotion and cruise passages.

The Prize is not transferrable or redeemable for cash and must be accepted as awarded, with no substitutions of any kind, except by Cruise Experts Travel, which reserves the right to substitute any prize (or portion thereof), with one of comparable or greater value, at its sole discretion. Winner and companion are responsible for obtaining all necessary passports and travel documentation. Winner is solely responsible for any and all expenses, and applicable federal, state and local taxes associated with claiming or using the prize. ALL FEDERAL, STATE AND LOCAL TAXES, AND OTHER CHARGES, IF ANY, ARE THE WINNER’S SOLE RESPONSIBILITY.

YOU RELEASE CRUISE EXPERTS TRAVEL FROM ANY LIABILITY OR INJURIES INCURRED IN CONNECTION WITH PARTICIPATION IN THIS CONTEST OR ACCEPTANCE OR USE OF ANY PRIZE. THE PRIZE IS AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE). ACCEPTANCE OR USE OF A PRIZE IS AT THE WINNER’S OWN RISK.

7. Winner Notification. If you are selected as the Winner, you will be notified by email or phone call within 30 days after the end of the Contest Period. You will be sent via email an Affidavit of Eligibility/Release of Liability Form, and where legal, a Publicity Release. You must execute and return any required Affidavit of Eligibility/Release of Liability Form, and, where legal a Publicity Release, within fourteen (14) days of receipt. Non-compliance within this time period or return of Affidavit of Eligibility/Release of Liability Form as undeliverable may result in disqualification, and the second place winner being selected, at Cruise Experts Travel’s sole discretion. Tennessee residents need not sign the Publicity Release.

8. Publicity. By entering the Contest, you grant to Cruise Experts Travel the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), email address, voice, biographical information and written or oral statements, for advertising and promotional purposes in promoting or publicizing Cruise Experts Travel and its products and services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), email address, biographical information, or entry. The rights granted under this paragraph shall extend to all Entry Materials related to the Contest.

9. Release. By entering the Contest, you agree to release and hold harmless Cruise Experts Travel and Norwegian from and against any claim or case of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of prize.

10. Limitations of Liability. Cruise Experts Travel and Norwegian are not responsible for: (1) any incorrect or inaccurate information, whether caused by you, printing errors or by any of the equipment or programming associated with or used in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, by your participation in the Contest or receipt or use or misuse of any prize. No more than the states number of prizes will be awarded.

11. Termination. Cruise Experts Travel reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Cruise Experts Travel’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Cruise Experts Travel in its sole discretion. Cruise Experts Travel reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. If for any reason this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole and absolute opinion of Cruise Experts Travel, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Cruise Experts Travel reserves the right to cancel, terminate, modify or suspend the Contest, and award the Prize from among the eligible Entries received prior to such action to the extent feasible. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Cruise Experts Travel reserves the right to seek damages from any such person to the fullest extent permitted by law. Cruise Experts Travel’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

12. Disputes. Except where prohibited, you agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the Courts of British Columbia, Canada; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or your rights and obligations or those of Cruise Experts Travel, in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Province of British Columbia, without giving effect to any choice of law or conflict of law rules (whether of the Province of British Columbia or any other jurisdiction).
